Boy on bike gets €7,500 for collision injury

AN offer of €7,500 compensation to a boy who sustained injuries when his bike collided with a car was described by Judge Rory MacCabe at the Circuit Civil Court today (Friday) as “close to the third or fourth miracle of Fatima.”

Judge MacCabe made his comments at a sitting in Castlebar after hearing that the brakes on the then seven-year-old's bicycle weren't working at the time.

He continued: “It is hard to see they would have got over the hurdle of liability.”

The plaintiff in the case was suing the motorist involved in the accident at Sion Hiil, Pontoon Road, Castlebar, through his mother.

Conor Burke, counsel, told Judge MacCabe the boy sustained a fracture to his right leg in the impact when he went into the side of the car in 2014.

Counsel stated he was happy with the offer mindful of the fact that liability would be quite a hurdle in the case.

He added that the boy, in the opinion of Paul Gaffney, A&E consultant at Mayo University Hospital, has made a full recovery.

Judge MacCabe approved the offer of €7,500 plus legal costs.
